Background Information:
The Bureau of Ocean Energy Management Regulation and Enforcement (BOEMRE) in partnership with the National Marine Fisheries Service are the regulatory forces that deal with offshore enforcement of the Endangered Species Act. Practically, this means that any action done in offshore waters must be approved by the BOEMRE after consultation and notification of the National Marine Fisheries Service. Even if approved, environmental mitigation may be required as a part of the project.
